Teen Charged with Murder in Grandmother's Death

A 15-year-old Calgary youth accused of attacking his grandmother last month has now been charged with second-degree murder, following the woman's death from her injuries. The teen, who cannot be identified under the Youth Criminal Justice Act, appeared in a Calgary courtroom via video link from the Alberta Hospital in Edmonton, where he is receiving mental health care.

Charge Upgraded After Victim's Death

Initially charged with aggravated assault and mischief in connection with a March 29 incident at a home in the northeast community of Pineridge, the youth's charges were formally upgraded during a court appearance on Wednesday. Crown prosecutor Tara Wells informed youth court Justice Gay Benns that a new information had been filed, replacing the previous charges with a single count of second-degree murder.

"The Crown has approved the upgrading of charges as the named victim on that information is deceased," Wells stated in court. Police had announced on April 2 that the grandmother, a woman in her 50s, had succumbed to her injuries. Due to the relationship between the accused and the deceased, a publication ban also covers the woman's name.

Legal Proceedings and Representation

Defence counsel Robin McIntyre indicated she would be joining lawyer Leanndria Halcro in representing the accused on the murder charge. "I'm going to be coming on as co-counsel on the replacement information," McIntyre told the court. The youth appeared via video and did not address the court, other than confirming to Justice Benns that he could hear the Calgary proceedings.

With the murder charge now in place, the teen will have the choice of being tried in youth court or in the Court of King's Bench, either before a judge alone or by a jury. However, McIntyre stated that the defence was not yet prepared to make that election, requesting a two-week adjournment while awaiting disclosure from the Crown.

Background of the Case

Police initially charged the 15-year-old with aggravated assault after officers responded to a call about an altercation at a Pineridge residence around 7 p.m. on March 29. The teen was already on release for unrelated charges, including child pornography-related allegations and break and enter. He remains in custody at Alberta Hospital on the murder charge.

Wells noted that she is in the process of obtaining disclosure from investigators and expects to provide it to the defence shortly. The previous charging information alleging aggravated assault and mischief has been formally withdrawn.
