NDP MLA Rakhi Pancholi has denounced Premier Danielle Smith's characterization of a judge's ruling as undemocratic, calling the comments 'dangerous' for the province's democratic institutions. Speaking on Alberta Primetime with Michael Higgins, Pancholi criticized the United Conservative Party's intention to appeal the Court of King's Bench decision that struck down a separatist petition.
Background on the Ruling
The Court of King's Bench recently invalidated a petition filed by the group Stay Free Alberta, which sought to initiate separation discussions. The judge ruled that the petition did not meet legal requirements, a decision that Smith labeled as undemocratic. Pancholi argues that such rhetoric undermines public trust in the judiciary.
Pancholi's Response
'It is dangerous for a premier to call a judge's ruling undemocratic,' Pancholi stated. 'Our judicial system is a cornerstone of democracy, and attacking it erodes confidence in our institutions.' She emphasized that the proper recourse is through legal appeals, not public condemnation.
UCP's Appeal Plans
Stay Free Alberta has already filed an appeal of the decision, and the UCP government has expressed support for the challenge. Pancholi warned that this could set a troubling precedent for how the government interacts with the judiciary.
The controversy comes amid broader debates about Alberta's place within Canada, with separatist sentiments gaining some traction in recent years. However, Pancholi stressed that such issues should be resolved through democratic processes, not by attacking judges.
