A Windsor police constable who received a conditional discharge and two years of probation after pleading guilty to criminal harassment and indecent communications has been temporarily demoted. Constable Joshua Smith, an 18-year veteran of the force, was reduced from first-class constable to third-class constable for a period of two years, according to a disciplinary decision released Monday by hearing officer Greg Walton.
Details of the Misconduct
Smith had been charged with discreditable conduct following an incident in September 2023. During an Ontario Court of Justice trial, he admitted to making anonymous, sexually explicit phone calls to a female colleague's cellphone. The calls, which involved moaning and masturbation, were described in court as “unacceptable” and “terrifying.” Smith pleaded guilty to criminal harassment and indecent communications in April 2025.
Disciplinary Outcome
Windsor police officials confirmed that the service had requested Smith's dismissal, but Walton determined that a demotion, which also includes a reduction in pay, was sufficient. Deputy Chief Karel DeGraaf stated, “We respect the outcome of the disciplinary process. Our focus now is on moving forward in a way that considers the well-being and safety of everyone involved.”
In a statement provided to the Windsor Star, police officials said, “Following yesterday’s decision, we are developing a safety plan to ensure appropriate supports are in place for the person affected by these actions, and to maintain a safe and respectful workplace environment for everyone impacted. We remain committed to accountability, maintaining professional standards, and ensuring public trust.”
Legal Context
The conditional discharge Smith received during his Ontario Court of Justice trial means the court found him guilty of a criminal offence but, instead of entering a conviction, released him with specific conditions. As a result, Smith left court without a criminal record and was able to retain his policing position.
The demotion is effective immediately and will last for two years, after which Smith may be eligible to return to his previous rank.
