A Windsor-area father has been sentenced to two years in prison after sharing a pornographic image of his infant son on the social media app Kik. The sentence was handed down by Superior Court Justice Bruce Thomas, who emphasized the severity of crimes involving sexual violence against children.
Details of the Case
According to an agreed statement of facts, the father took naked photos of his infant son in 2021 and shared them with a woman on Kik, hoping to trade the images for intimate photos of a young girl he believed was the woman's daughter. However, the woman was actually a special agent with U.S. Homeland Security, who alerted Windsor police.
The Windsor Police Service's internet child exploitation unit arrested the man and found pornographic videos involving children on a cellphone seized from his home. The man pleaded guilty in December to one count of making child pornography. The Windsor Star is not naming the offender due to a publication ban protecting the victim's identity.
Sentencing Hearing
During the sentencing hearing, both the defense and the offender's family pleaded for leniency, requesting a sentence of house arrest. However, Justice Thomas ruled that a prison sentence was more appropriate given the gravity of the crime. He noted that social media and the internet have enabled new forms of sexual violence against children.
“He chose as his victim his youngest child, who he said in the Kik chat would not remember, but also could not report the conduct, and amounted to the most vulnerable member of his family,” Thomas said.
Mitigating Factors
The judge acknowledged several mitigating factors, including the man's lack of a prior criminal record, a meaningful guilty plea, and a low risk of reoffending. Family members had written character letters stating the man continues to provide essential financial support as they attempt to establish normalcy for the children.
Despite these factors, Thomas emphasized that victims of child pornography must be placed at the center of the sentencing process. The man's family cried as the sentence was delivered.
