Penticton RCMP Issues Public Advisory Over Man Filming Without Consent
The Penticton RCMP has issued a public advisory regarding an individual who has been observed videotaping businesses and people without their consent in the Kelowna and Penticton areas. The incidents occurred on March 17, 2026, prompting police to warn residents about potential safety concerns.
Man Claims Educational Purpose for Filming
According to police spokesman Constable Olivier Nelis, the man is reportedly wearing a high-visibility orange sweater and has been approaching individuals in downtown areas. He informs those he films that he is creating content for a podcast and YouTube channel, with the stated goal of educating the public about laws surrounding recording in public spaces.
"Nonetheless his objective remains unclear," Nelis emphasized in a statement. "Police have received multiple complaints from both the public and business owners about this individual, who has been described as exhibiting intimidating and disturbing behavior."
Police Advice for Those Encountering the Individual
The RCMP has provided specific guidance for anyone who feels targeted by this individual's filming activities:
- Do not engage with the individual if the filming feels intrusive, disruptive, or concerning.
- Document the incident safely when possible, noting details such as time, location, and descriptions.
- Report the incident directly to the RCMP for further investigation.
Legal Context of Public Recording in British Columbia
In British Columbia, video recording individuals in public spaces is generally not considered a criminal offense unless it can be proven that the recording was conducted for voyeuristic sexual purposes. This legal nuance adds complexity to situations where individuals feel their privacy has been violated but where no explicit illegal intent can be established.
The RCMP continues to investigate the complaints and monitor the situation, urging community members to remain vigilant while authorities work to clarify the individual's motives and ensure public safety.
