The defense team argues they require additional time to thoroughly review a substantial volume of material, including a critical ballistics analysis that may contribute to their client's defense strategy.
Ballistics Analysis Remains Inconclusive, According to Court Filings
In recent court documents, the defense for Tyler Robinson highlighted that an analysis conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) could not definitively link a bullet fragment recovered during the autopsy to the rifle discovered near the crime scene. The Federal Bureau of Investigation is currently conducting further tests, as noted in the filings.
While the full ATF report remains confidential, attorneys have referenced excerpts in public documents indicating the results were inconclusive. Forensic ballistics experts emphasize that the success of such analyses heavily depends on the size and condition of the bullet fragments. Investigators search for unique, microscopic markings—akin to fingerprints—left on a bullet as it travels through a firearm's barrel, with no two guns producing identical patterns.
Prosecution Seeks Death Penalty in Aggravated Murder Case
Prosecutors have charged Robinson, 22, with aggravated murder in the September 10 shooting of Charlie Kirk on the Utah Valley University campus in Orem. They have announced their intention to seek the death penalty. Robinson has not yet entered a formal plea.
Authorities allege that DNA consistent with Robinson's was found on the trigger of the rifle, the fired cartridge casing, and two unfired cartridges. However, defense attorneys point out that forensic reports indicate the presence of multiple individuals' DNA on some items, necessitating a more complex analytical approach.
Defense Strategy and Upcoming Proceedings
The defense motion suggests they may utilize the inconclusive ballistics analysis to challenge the prosecution's case during the preliminary hearing, aiming to demonstrate insufficient evidence to proceed to trial.
