Further investigation exposed that Kielty's employment agency, One Team, facilitated these illegal hires. Authorities discovered approximately 90 foreign nationals from Mexico working without proper authorization across four different resort hotels in the Banff and Jasper region. This systematic violation of employment regulations prompted serious legal action against the responsible parties.
Specific Charges and Legal Framework
On May 30, 2024, Kevin Kielty faced formal charges under the Immigration and Refugee Protection Act (IRPA), including:
- Section 124(1)(c) for employing foreign nationals in capacities for which they lacked proper authorization
- Section 131 for counseling foreign nationals to work in Canada without legal permission
