Two men from Fort Frances, Ontario, have been charged with impaired driving after they were observed switching seats in a McDonald's parking lot. The incident occurred on July 9, 2026, when Ontario Provincial Police (OPP) officers witnessed the two individuals exchanging positions in a vehicle. Police conducted an investigation and subsequently charged both men with impaired driving offences.
Details of the incident
According to the OPP, officers were on patrol when they noticed a vehicle in the McDonald's parking lot on Scott Street in Fort Frances. The driver and passenger were seen swapping seats, prompting police to approach the vehicle. Upon speaking with the occupants, officers suspected alcohol consumption and administered roadside breath tests. Both men failed the tests and were taken into custody.
The driver, a 34-year-old man, was charged with impaired driving and operating a motor vehicle with a blood alcohol concentration over 80 mg per 100 ml of blood. The passenger, a 29-year-old man, was charged with being in care or control of a motor vehicle while impaired and with a blood alcohol concentration over the legal limit. Both individuals are scheduled to appear in court in Fort Frances at a later date.

The OPP has emphasized that switching drivers does not avoid legal consequences if the individual had care or control of the vehicle while impaired. Sergeant Carla Smith of the OPP said, "This incident shows that our officers are vigilant and that any attempt to evade responsibility will be met with enforcement. Impaired driving puts everyone at risk, and we will continue to hold offenders accountable."
