Imperial Oil Ltd is paying a $120,000 penalty after pleading guilty to a wastewater spill at its Kearl oilsands mine in 2023. The incident occurred at one of the company's tailings ponds near Fort McMurray, Alberta.

Details of the Spill

According to an agreed statement of facts, nearly 5.2 million litres of industrial wastewater spilled, reaching up to 200 metres from the site before freezing. The open-pit mine spans 130 square kilometres and includes processing plants, tailings ponds, and disposal areas.

An Alberta court found the company guilty of violating environmental regulations. In addition to the penalty, Imperial Oil was required to clean up the spill.

Penalty Breakdown

Only $2,000 of the $120,000 penalty is a fine. The remaining $118,000 will fund a “creative” sentencing project determined by regulators. The project must demonstrably benefit Alberta public lands, Indigenous traditional territory, wetlands, or surrounding ecosystems.

Filings indicate the pond had operated for eight years before the incident. The statement of facts confirmed that water from the spill did not reach the nearby Firebag River, as verified by both Imperial and the Alberta Energy Regulator.
