The Ontario Court of Appeal has upheld the $5.25 million bail for Deepak Paradkar, the flamboyant lawyer once known as the 'cocaine lawyer,' who is fighting extradition to the United States for his alleged role in client Ryan Wedding's global drug trafficking network.
Background of the Case
Paradkar, 62, was arrested last November on charges related to counseling the murder of an FBI confidential informant in Colombia. The informant was executed with five bullets to the head while dining with friends in Medellin. Paradkar has denied the allegations.
U.S. officials allege that Paradkar advised Wedding that killing the informant would collapse the prosecution's case against the former Canadian Olympic snowboarder turned narco kingpin. Wedding, one of the ten most wanted fugitives in the U.S., surrendered in Mexico in January and is currently in American custody awaiting trial.
Appeal Court Decision
The Crown had appealed the initial release decision by Superior Court Justice Peter Bawden, arguing that he made legal errors, including failing to properly scrutinize Paradkar's wife as the primary surety and not considering the couple's 'unexplained wealth' that could facilitate flight.
However, the appeal panel, led by Justice Katherine van Rensburg, disagreed. The court found that the main issue was not whether Paradkar had the financial means to escape, but whether he had the incentive to do so. The judge reasonably concluded he did not.
The court also rejected the Crown's argument that releasing Paradkar would undermine public confidence in the justice system. Justice van Rensburg noted that a reasonable person, fully informed of the facts, would understand that bail decisions can be difficult and would find reassurance in the judge's careful explanation.
Paradkar's Defense
Paradkar argued that the case against him relies entirely on a confidential witness who has an incentive to lie to obtain a favorable deal. The appeal court acknowledged that the trial judge recognized serious credibility concerns with the witness's evidence.
The court also considered Paradkar's health issues, including diabetes, heart disease, high blood pressure, and a recent quadruple heart bypass. His deep ties to his wife of 32 years, a colon cancer survivor, and their two daughters, both lawyers, were also factors in the decision.
Financial Situation
Court documents reveal that the Paradkars own a Thornhill home appraised at $5 million, a Muskoka cottage, and four leased luxury vehicles valued at over $200,000. The Crown had argued that their lavish lifestyle did not match Paradkar's reported law practice income, suggesting it was funded by Wedding's criminal enterprise.
U.S. officials allege that Paradkar was paid with bulk cash drops and luxury watches for his services. However, the appeal court found that the judge reasonably concluded that Paradkar had no incentive to flee, given his strong ties to Canada and his health condition.
The 'cocaine lawyer' remains free, confined to his comfortable suburban mansion as he awaits the next stage of his legal battle.
