The penalty was imposed by the Occupational Health and Safety (OHS) division following a guilty plea in Edmonton Court of Justice on May 26.

The incident occurred on June 23, 2023, when a worker was performing post-tensioning work on a segment of the Edmonton Valley West LRT line. During the operation, the worker was struck by falling equipment and sustained serious injuries. An investigation by OHS found that Marigold failed to ensure that equipment or materials were properly contained, restrained, or protected to eliminate potential dangers, violating the OHS code.

Legal Proceedings

Marigold pleaded guilty to one count under the OHS code. The Crown withdrew 13 additional counts and dropped charges against two related entities. The court imposed a $120,000 fine, which includes a victim fine surcharge. The company has 30 days to appeal the conviction or penalty.
