A Belle River massage therapist convicted of sexual assault made an emotional plea during his sentencing hearing on Wednesday, begging the court to allow him to remain out of prison. The man, whose name is under a publication ban, was found guilty earlier this year of sexually assaulting a female client during a treatment session in 2023.

In a statement read by his lawyer, the therapist expressed deep remorse for his actions, stating, 'I do want to be punished, but I beg you to let me stay out of prison. I have learned my lesson and want to continue my rehabilitation.' The victim, who was in the courtroom, wept as the statement was read.

The Crown prosecutor argued for a significant jail sentence, emphasizing the breach of trust inherent in the therapist-client relationship. 'This was not a mistake; it was a deliberate act of sexual violence,' the prosecutor said.

Defense Arguments

The defense highlighted the therapist's lack of prior criminal record, his family responsibilities, and his ongoing counseling as reasons for a conditional sentence. They also noted that he has voluntarily stopped practicing massage therapy since the charges were laid.

Justice Margaret O'Neil reserved her decision until June 15, allowing time to consider the submissions. She reminded the court that the maximum penalty for sexual assault is 10 years in prison.

The case has drawn attention to the regulation of massage therapists in Ontario, with advocates calling for stricter oversight and mandatory reporting of sexual misconduct.
