Windsor man faces charges for failing to move over on Hwy 401

A Windsor man is facing multiple charges, including impaired driving, after Ontario Provincial Police say he failed to move over for an emergency vehicle stopped on Highway 401 in Lakeshore.

Incident Details on Highway 401

The incident occurred on Thursday, January 16, 2026, at approximately 2:45 p.m. An OPP officer was assisting a tow truck operator on the side of the highway following a collision. According to police, the officer's cruiser had its emergency lights activated.

A vehicle, driven by a 42-year-old man from Windsor, allegedly passed the scene without moving into another lane as required by law. This prompted the traffic stop and subsequent investigation.

Multiple Charges and Immediate Penalties

The driver now faces a combination of Criminal Code and Highway Traffic Act offences. The specific charges include:

  • Operation of a motor vehicle while impaired
  • Dangerous operation of a motor vehicle
  • Failure to move into another lane for an emergency vehicle or tow truck

In addition to the charges, the driver received an immediate 90-day driver's licence suspension. His vehicle was also impounded for seven days.

OPP Reminds Public of Move Over Law

The OPP used this incident to remind all motorists of Ontario's Move Over Law. This legislation requires drivers, when approaching an emergency vehicle stopped with its lights flashing, to slow down and proceed with caution. If it is safe to do so, drivers must move into another lane to create a space of safety.

The law is designed to protect police officers, paramedics, firefighters, tow truck operators, and other roadside workers. Failure to comply is not just a traffic ticket; it can result in significant fines, demerit points, and, most importantly, can lead to serious injury or death.
