A Virginia judge has dismissed felony child neglect charges against a former elementary school administrator who was accused after a 6-year-old student shot a teacher. The case, which drew national attention, concluded on May 21, 2026, in Newport News Circuit Court.

Judge David F. Pugh granted the defense's motion to strike the evidence, ruling that prosecutors failed to prove that former assistant principal Ebony Parker acted with criminal negligence. Parker, 40, had faced four counts of felony child neglect for her role in the January 2023 shooting at Richneck Elementary School.

Prosecution's Case

Prosecutors argued that Parker failed to follow safety protocols and did not adequately respond to warnings about the 6-year-old boy's behavior on the day of the shooting. The boy brought a gun to school and shot first-grade teacher Abigail Zwerner in the hand and chest. Zwerner survived after multiple surgeries.

Defense Argument

Parker's attorneys maintained that she was not criminally responsible, stating that she followed school procedures and that the shooting was a tragic but unforeseeable event. They emphasized that Parker had no knowledge the child had a gun.

Aftermath

The dismissal means Parker will not face trial. She had been placed on administrative leave after the incident and later resigned. The school district has since implemented new safety measures, including metal detectors and increased security training.

The 6-year-old, who cannot be criminally charged due to his age, was placed in a mental health facility. His mother was previously charged with felony child neglect for allowing access to the firearm.

Zwerner has filed a $40 million lawsuit against the school board, alleging negligence. The case is ongoing.
