Judge's Frustration
Justice Michael O'Dea noted that while the sentence was within the range suggested by both parties, he felt it did not adequately address the severity of the offenses. Berdan, 42, had pleaded guilty to possession of cocaine for the purpose of trafficking and possession of fentanyl. The court heard that police executed a search warrant at his residence in January 2025, seizing 28 grams of cocaine, 10 grams of fentanyl, and digital scales.
Prior Record
Berdan has a lengthy criminal record, including prior convictions for drug trafficking. Crown attorney Sarah Thompson argued that Berdan's history demonstrated a pattern of recidivism and a disregard for the law. Defense lawyer Mark Sandler countered that Berdan had taken steps to address his addiction and was motivated to change.
Plea Deal Details
The plea deal resulted in a six-month jail sentence, followed by 12 months of probation. Berdan was also ordered to provide a DNA sample and is prohibited from possessing weapons for 10 years. Justice O'Dea stated, "I am reluctantly accepting this joint submission. The public may see this as too lenient, but my hands are tied by the agreement."

Outside the courtroom, community advocates expressed disappointment. "This sends the wrong message," said Jane Doe of the Barrie Community Safety Coalition. "Repeat dealers are fueling the opioid crisis, and we need stronger deterrents."
