Toronto Police have upgraded a charge to manslaughter following the death of a 34-year-old man who was injured in an altercation in the city's downtown core last month.
Details of the Fatal Downtown Altercation
According to police, the incident occurred in the early hours of December 28, 2025, around 1:20 a.m., in the area of Front Street and University Avenue. Officers initially responded to a call for a medical complaint.
Investigators allege that a verbal argument took place outside an establishment between the suspect and the victim. The confrontation turned physical when the suspect assaulted the victim, causing him to fall to the ground.
The victim regained his footing, but was allegedly assaulted a second time by the same suspect. This second attack caused the victim to fall again, lose consciousness, and suffer critical injuries. The suspect then fled the scene before police arrived.
Victim Succumbs to Injuries, Charge Upgraded
The victim, identified as Luke Daniel Kellet-Smith, was transported to hospital and placed on life support. He tragically succumbed to his injuries and was pronounced dead on December 31, 2025.
As a result of the death, the initial charge against the suspect was upgraded. Bernard Emeka Oneh, 30, of Richmond Hill, now faces a manslaughter charge, which was escalated from the original charge of aggravated assault.

Other Police Investigations in the GTA
In a separate incident in Peel Region, police are investigating a suspected arson involving multiple tow trucks. Peel Regional Police reported that several tow trucks were set on fire in Brampton around 3:30 a.m. on Monday in the area of Rutherford Road and Glidden Road.
Preliminary evidence suggests four to five individuals were involved before fleeing in an unknown direction. No injuries were reported. The investigation is ongoing, and police have not yet released suspect descriptions.
Additionally, in a Toronto police operation from late December, a 30-year-old Toronto man faces multiple charges following a firearm and drug bust. Jordan Agostino was arrested on December 25 in the Bloor and Yonge streets area after allegedly fleeing from officers attempting to execute a warrant.
Police allege he was found in possession of a loaded firearm, a large quantity of cocaine, and cash. A subsequent search warrant execution allegedly uncovered more cash, Oxycodone, and additional cocaine. Agostino faces six firearm-related charges, along with drug trafficking and proceeds of crime charges.
