Court Double-Booking Delays Trial for ER Doctor Accused of Sex Crimes
The trial for an emergency room physician facing multiple sex charges involving a minor, which was scheduled to begin on Friday, has been adjourned for several weeks due to a court scheduling conflict. The delay stems from the courtroom being double-booked, pushing the proceedings to a later date.
Details of the Adjournment
Dr. Robert Wismer's trial was on the docket to start at 10 a.m. on Friday, but another trial was already in process in the same courtroom at that time. Around 12:40 p.m., Wismer's lawyer was called into the courtroom, and shortly after, it was confirmed that the trial had been adjourned to June 1. This date is one of four previously booked trial slots, with the postponement attributed to the court's busy schedule.
The trial was originally set to begin on April 2, but that date was vacated earlier. The adjournment adds another layer of delay to a case that has been pending for months.
Background of the Charges
According to the College of Physicians and Surgeons of Ontario, Wismer was charged on October 14, 2024, with three counts each of sexual assault, sexual interference, and invitation to sexual touching. These charges relate to alleged incidents involving individuals younger than 16, occurring between August 29 and October 12, 2024.
Wismer, a native of Thamesville, previously worked as an emergency physician at the Chatham-Kent Health Alliance, where he had been employed since 2019. The case is subject to a publication ban, limiting the disclosure of specific details to protect the identities involved.
Release Conditions and Restrictions
Wismer was released on conditions that include not contacting or communicating with, or being within 10 metres of, certain individuals or their residences, workplaces, or educational institutions, except for court appearances. Additionally, he must avoid places where people younger than 16 are present or expected to be, and he cannot be alone with any child under 16, other than his own, unless accompanied by another adult who is aware of the charges.
The adjournment highlights the complexities and delays often encountered in the justice system, particularly in high-profile cases involving serious allegations. The rescheduled trial date in June will be closely monitored as the legal process continues to unfold.
