These lawsuits challenge President Donald Trump's use of an economic emergency powers law to impose the levies. While smaller businesses and Democratic state officials initially drove the legal fight this year, Costco's entry marks a major corporate player stepping into the fray.

The Supreme Court heard arguments on the legality of Trump's tariffs on November 5, 2025. Although the justices placed the case on a fast-tracked schedule, they have not indicated when a final ruling will be issued. In this climate of uncertainty, companies of all sizes are launching cases with similar legal claims. Their primary goal is to remove any doubt about their right to receive refunds for duties paid if the court rules against the administration.

Costco's Legal Argument and Immediate Concerns

Costco's legal complaint, filed on November 28, 2025, was prompted by the lack of a guaranteed refund mechanism for all businesses that have paid duties under the tariffs. The company's lawyers stated that the lawsuit seeks a court intervention to resolve this uncertainty. While the filing does not specify the total financial impact the tariffs have had on Costco to date, the stakes are clearly high.

The retailer argues that immediate court action is necessary because U.S. Customs and Border Protection denied its request to extend the schedule for finalizing tariff determinations.
